At St. Clare Heirloom Seeds, we take great care to provide high-quality, true-to-type seeds that meet or exceed Federal Germination Standards before they leave our facilities. However, seeds are living organisms, and their growth and performance depend on many factors beyond our control. For that reason, we cannot guarantee specific results and make the following disclaimers:
Growing Conditions Beyond Our Control
Once seeds leave our facilities, their success depends on a wide variety of circumstances that we cannot influence, including but not limited to:
- Weather patterns, such as heat, frost, drought, or excessive rain.
- Soil type, fertility, pH balance, and the presence of soil-borne diseases or pests.
- Storage conditions prior to planting, including exposure to heat, humidity, and light.
- Proper timing, depth, and spacing of planting.
- Adequate and consistent watering.
- Use of fertilizers, weed controls, fungicides, and insecticides.
- Overall skill, knowledge, and gardening practices of the grower.
Because these factors are outside our control, St. Clare Heirloom Seeds cannot be held responsible for poor germination, crop failure, or lower-than-expected yields.
Intended Use of Seeds
Our seeds are sold for the purpose of home gardening, education, and small-scale agricultural use. They are not intended for large commercial farming operations.
Limitation of Liability
By purchasing seeds from St. Clare Heirloom Seeds, you acknowledge and agree to the following:
- Our liability is limited strictly to the purchase price of the seeds in question.
- We are not liable for incidental or consequential damages of any kind, including but not limited to crop loss, lost income, adverse health, or damages resulting from the use of our seeds or products.
- Remedies offered in cases of concern may include replacement seeds, store credit, or a discount toward future purchases, at our sole discretion.
No Guarantee of Results
While we stand by the quality of our seeds and the care we put into storing and handling them, we cannot guarantee 100% germination or crop success. Gardening and farming are subject to forces of nature and human management that vary widely from place to place and year to year.
Acceptance of Terms
By placing an order with St. Clare Heirloom Seeds, you agree to accept these disclaimers in full and release us from liability for results outside our control.
